1. Introduction
Welcome to OpenHorizonCommons ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at openhorizoncommons.sbs (the "Service") operated by OpenHorizonCommons.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
OpenHorizonCommons offers upscale yacht charter services, which may include:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Service availability is contingent on weather conditions. We maintain the right to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
Charter booking requirements are as follows:
- Minimum age of 18
- Provision of valid and complete details
- Submission of the requisite deposit as delineated in the booking acknowledgment
- Acceptance of these Terms & Conditions
3.2 Confirmation
Confirmation of your booking occurs with payment receipt and a subsequent written confirmation from us. We reserve the right to decline service at our discretion.
3.3 Availability
Charters are offered based on the availability of vessels and appropriate weather. We endeavor to accommodate your preferred scheduling to the best of our abilities.
4. Payment Terms
4.1 Pricing
All prices stated in € include taxes, except where stated otherwise. Prices may be subject to adjustments without prior notification.
4.2 Payment Schedule
- Deposit: 50% of total charter cost payable upon booking
- Balance: Due 48 hours in advance of charter departure
- Further charges (as applicable): Payable post-charter completion
4.3 Payment Methods
We accept numerous payment methods such as major credit cards, bank wires, and certified cheques. Secure, encrypted processes are employed for payment handling.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Mitigating circumstances more than 72 hours prior to departure: Refund after deducting processing fees
- 24-72 hours ahead of departure: 50% refund
- Within 24 hours of departure: Non-refundable
5.2 Weather Cancellations
In the instance of unfavorable weather as determined by our captain, options provided include:
- Charter rescheduling to a subsequent available date at zero additional charge
- Issuance of a full refund if rescheduling isn't feasible
5.3 Mechanical Issues
Should there be any mechanical issues with the designated vessel, we will make an effort to supply a comparable alternative. If no alternative is obtainable, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Heed all instructions from the crew
- Don necessary safety gear when indicated
- Disclose medical conditions that might affect their safety
- Stay within specified regions of the vessel
6.2 Prohibited Items
The below items are not allowed on board:
- Glass containers
- Illegal substances
- Firearms or weapons
- Substance abuse beyond reasonable levels (including non-alcoholic beverages such as juices or lemonade)
- Animals (except when given permission in advance)
6.3 Conduct
We expect all guests to behave in a courteous manner. A charter may be terminated prematurely without a refund if a guest's conduct endangers safety or interferes with others' experiences.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the amount you have paid for the charter. Responsibilities not assumed by us include:
- Injuries caused by a guest's negligence
- Theft or damage of personal belongings
- Indirect, consequential, or exemplary damages
- Delays led by adverse weather or situations outside our control
7.2 Insurance Coverage
Our operations and vessels are covered by comprehensive marine insurance. It's the responsibility of guests to ensure they have adequate travel and personal insurance.
7.3 Assumption of Risk
Engagement in our charter services signifies your acknowledgment of the inherent risks associated with maritime activities and your acceptance of responsibility for your personal safety.
8. Modifications and Itinerary Changes
Variations to itineraries, journeys, or timetables may occur based on meteorological conditions, safety necessities, or operational imperatives. We strive to offer suitable alternative experiences.
9. Force Majeure
Our company is not accountable for any delays, cancellations, or changes resulting from scenarios beyond our influence, including:
- Severe meteorological events
- Natural calamities
- Regulatory mandates
- Port shutdowns
- Mechanical failures
10. Privacy and Data Protection
Your private data is managed following our Privacy Policy. Utilizing our services constitutes consent to data handling as specified in our Privacy Policy.
11. Intellectual Property
Intellectual property on our website including text, graphics, trademarks, and images is safeguarded by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivatives is not permitted without our explicit permission.
12. Governing Law
The applicable laws of Greece govern these Terms. All disputes will be adjudicated in the courts situated in Lefkada, Greece.
13. Changes to Terms
We retain the right to modify these Terms at any moment. Amended terms will be posted on our website with the revision date updated. Ongoing use of our services means acceptance of the amended terms.
